OUR POLICIES
By engaging Truene Creative for any project or service, you confirm your acceptance of these terms and conditions, whether or not a formal contract has been signed.
1. Payment Terms & Late Fees
All invoices are due by the stated payment deadline. If payment is not received on time, a late fee of £12 per day will be applied until the balance is settled.
-
A deposit may be required before work begins, depending on the project.
-
Full payment must be received before final files are delivered or campaigns go live.
-
Any additional work outside the agreed scope will be invoiced separately.
-
If a client fails to pay within 30 days of the due date, Truene Creative reserves the right to pause all work until payment is received.
-
In cases of continued non-payment, Truene Creative reserves the right to instruct a debt collection agency or take legal action to recover outstanding fees. Any associated costs incurred in recovering the debt will be added to the amount owed.
2. Intellectual Property & Usage Rights
All creative work, including but not limited to branding, designs, graphics, marketing materials, and written content, remains the intellectual property of Truene Creative unless otherwise agreed in writing.
-
Clients are granted a licence to use the final, approved work for the agreed purpose.
-
Unused, draft, or alternative concepts remain the property of Truene Creative and may not be used or repurposed by the client.
-
Truene Creative retains the right to showcase completed work in portfolios, case studies, and marketing materials unless a non-disclosure agreement (NDA) has been signed.
-
Modification or redistribution of our work without prior written consent is not permitted.
If exclusive ownership is required, this must be agreed upon in advance and may be subject to additional fees.
3. Revisions & Approvals
-
Each project includes a specified number of revisions. Additional revisions beyond the agreed scope will be charged separately.
-
Once final approval is given, Truene Creative is not responsible for any errors, omissions, or changes.
-
Any requests for modifications after final approval may result in additional charges.
4. Project Timelines & Client Responsibilities
-
Estimated turnaround times are provided at the start of each project.
-
Delays in client responses, approvals, or providing necessary materials may impact deadlines.
-
If a project is delayed for more than 14 days due to a lack of client communication or required materials, Truene Creative reserves the right to pause or reschedule the project.
5. Cancellations & Refunds
-
If a project is cancelled by the client after work has begun, any payments made are non-refundable.
-
If cancellation occurs before work begins, any deposits or upfront payments may be refunded at the discretion of Truene Creative.
-
If Truene Creative must cancel a project for any reason, a fair refund will be issued based on work completed.
6. Confidentiality & Data Protection
-
All client information and materials shared with Truene Creative will be kept confidential.
-
Truene Creative will not share, sell, or distribute client data to third parties.
-
If necessary, clients may request a non-disclosure agreement (NDA) before work begins.
7. Limitation of Liability
-
Truene Creative is not responsible for indirect losses, damages, or third-party issues arising from the use of our designs or marketing materials.
-
Clients must review and approve all work before publication or distribution. Any errors must be reported within 7 days of receiving final files.
-
Truene Creative is not liable for any business or financial loss resulting from marketing campaigns or design use.
8. Portfolio & Marketing Use
Truene Creative reserves the right to showcase completed work in its portfolio, website, and promotional materials unless agreed otherwise in writing. This includes case studies, social media features, and award submissions.
9. Third-Party Costs & Licences
-
Any third-party costs (e.g., stock images, fonts, plugins) required for the project may be charged separately if not included in the original agreement.
-
Clients are responsible for purchasing and maintaining licences for third-party assets if required.
10. Termination of Services
-
Either party may terminate the agreement if the other party breaches these terms.
-
Any outstanding payments must be settled before work is handed over.
-
Truene Creative reserves the right to discontinue work with clients who repeatedly fail to provide timely feedback, delay payments, or do not adhere to agreed timelines.
11. Policy Updates
-
Truene Creative reserves the right to modify or update this policy at any time. Any changes will be reflected on our website, and continued engagement with our services will constitute acceptance of the revised terms.
